The purpose of these General Terms and Conditions of Sale (GTCS) is to govern the contractual relationship between IMMERSIVE SOUNDSCAPES (hereinafter “the Seller”), and any natural or legal person (hereinafter “the Buyer”) making a purchase on the websites immersivesoundscapes.fr or immersivesoundscapes.com.
Placing an order implies full and unreserved acceptance of these GTCS. The Seller reserves the right to modify these conditions at any time. The conditions applicable to an order are those in force on the date of payment.

All products offered (EarSight microphones, accessories, and components) are brand new unless stated otherwise. All elements of the website, including visual assets, layouts, and sound samples, are the exclusive intellectual property of IMMERSIVE SOUNDSCAPES. Any unauthorized reproduction is strictly prohibited.
Prices displayed on the website are in Euros (€).
VAT Application depending on the Buyer’s status:
Private consumers (B2C) in France: Prices include French VAT at the current legal applicable rate (20%).
Private consumers (B2C) within the European Union (outside France): In accordance with EU VAT regulations (One-Stop Shop / OSS system), sales are subject to the VAT rate applicable in the country of destination (the Buyer’s delivery/residence country). The relevant local VAT is calculated and applied at checkout.
Professional buyers (B2B) within the European Union (outside France): Orders are invoiced tax-free (excluding VAT), provided that the Buyer enters a valid intra-community VAT number during the checkout process. The reverse-charge mechanism applies: the professional Buyer is solely responsible for declaring and paying the VAT within their own country.
Buyers outside the European Union (B2C & B2B): Orders are invoiced tax-free (excluding VAT).
Shipping Costs: Prices do not include shipping costs, which are calculated at checkout based on the delivery method, order size, or destination.
Customs and Local Taxes (Outside the EU): For deliveries outside the European Union, the Buyer is the importer of record. Any local import duties, taxes, or customs clearance fees encountered upon arrival in the destination country are the sole responsibility of the Buyer.
Orders can be placed via the official website, or authorized third-party platforms (e.g., eBay, Reverb, LeBonCoin). Orders are accepted subject to product availability. A confirmation email will be sent to the Buyer once the order is successfully registered.
Payment must be made in full at the time of ordering via the secure payment gateways provided (PayPal, Stripe/Credit Card) or by bank transfer (BIC/IBAN available upon request). Products will only be dispatched once full payment has been cleared.
An itemized invoice showing the VAT breakdown (or explicitly mentioning the tax exemption or reverse-charge mechanism for professionals and non-EU exports) will be sent to the Buyer electronically.
Late Payment Penalties (B2B Only): In accordance with Article D. 441-5 of the French Commercial Code, any professional Buyer in delay of payment will automatically owe a flat-rate recovery compensation of €40, in addition to late penalties. This fee does not apply to consumer/non-professional buyers.
Products are shipped to the delivery address or collection point (relay point) specified by the Buyer during checkout. Orders are generally processed and shipped within 2 to 4 business days.
For Consumer Purchases (B2C): In accordance with French consumer law, the risk of loss or damage to the goods passes to the Buyer only when they (or a designated third party) take physical possession of the package.
Package Inspection: Upon delivery, the Buyer must inspect the condition of the packaging and the products. In the event of damage, broken items, or open parcels, the Buyer must refuse the package or write precise, dated, and signed reservations on the carrier’s delivery slip. Vague statements such as “subject to unpacking” have no legal standing.
In accordance with Article L. 221-18 of the French Consumer Code, individual consumers within the European Union have a period of fourteen (14) days from the receipt of their items to exercise their right of withdrawal without giving any reason.
Return Process:
The Buyer must contact the Seller at immersivesoundscapes@gmail.com within 14 days of receipt to notify their intent to return the product.
The Buyer then has an additional 14 days to ship the items back to the Seller’s address.
Return Costs: In accordance with Article L. 221-23 of the Consumer Code, return shipping costs are the sole responsibility of the Buyer, except in cases where the return is due to a confirmed manufacturing defect.
Condition of Goods: The Buyer is liable for any depreciation of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and proper functioning of the product.
Refunds: The Seller will issue a full refund (including the collected VAT) using the original payment method within 14 days of receiving the returned items or receiving proof of return shipment.
The Seller provides a 2-year commercial warranty on all EarSight microphones.
Scope: This warranty covers hidden defects, component failures, and manufacturing malfunctions under normal and intended use. Each microphone is rigorously tested prior to shipping to ensure perfect functionality.
Exclusions: The warranty does not cover damage caused by misuse, negligence, lack of care, accidents, or unauthorized modifications. The Seller reserves the right to refuse warranty coverage if proper care was not taken.
Procedure: The Buyer returns the defective item at their own expense. If the defect is covered by the warranty, the Seller will repair or replace the product and ship it back to the Buyer at the Seller’s expense. If no defect is found, return shipping costs will be charged to the Buyer.
These General Terms and Conditions are governed by and construed in accordance with French law. In the event of a dispute, the parties shall first attempt to reach an amicable resolution. Failing an amicable agreement, any legal action will be subject to the exclusive jurisdiction of the competent French courts.
